NO SMOKING Legislation!
From 1st July 2007, nearly all enclosed public and work places in England became smoke free under The Health Act 2006
So what does this mean for the average person?
The legislation applies to ALL 'enclosed' or 'substantially enclosed' premises that are used as places of work by one or more persons, and/or where members of the public may attend and/or receive or provide goods and services.
Premises are considered to be 'substantially enclosed' if they have a roof or ceiling, but there are door and window openings as appropriate.
The Regulations set out requirements for provision of 'No Smoking' signs.
All non-smoking premises must:

  • Display signs equivalent to A5 size in area, carrying the international no-smoking symbol and wording such as 'No Smoking; It is against the law to smoke in these premises'.
  • Alternative phrasing - eg. 'this Community Centre', 'this Sports Centre' etc. is permitted.
  • There are alternative arrangements for entrances used by staff.

There are seperate requirements for vehicles.
'Enclosed vehicles' are required to be smoke free if they are used:
  • By members of the public (whether or not for reward or hire).
  • In the course of paid or voluntary work by more than one person, even if those persons use the vehicle at different times or intermittently.

Private dwellings are usually exempt, unless:
  • Parts of it are used as a place of work for more than one person who does not live in the dwelling.
  • People who do not live in the dwelling come to give or receive goods or services.
